1. Acceptance of Terms

By accessing or using ForeverPet ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service. We reserve the right to update these terms at any time, and continued use of the Service constitutes acceptance of any changes.

2. Description of Service

ForeverPet is a digital pet memorial platform that allows users to create, customize, and share online memorials for their beloved pets. The Service includes memorial creation tools, photo and video galleries, gift features, and sharing capabilities.

3. User Accounts

• You must provide accurate and complete information when creating an account
• You are responsible for maintaining the security of your account credentials
• You must be at least 13 years old to use the Service
• One person may not maintain more than one account
• You are responsible for all activity that occurs under your account

4. Subscriptions, Payments & Taxes

• ForeverPet offers Free, Premium, Multi-Pet, and Lifetime subscription tiers
• Paid subscriptions are billed on a recurring basis (monthly), except for the Lifetime plan which is a one-time payment
• You may cancel your subscription at any time; access continues until the end of the billing period
• Refunds are available within 14 days of the initial purchase if no memorial content has been created
• We reserve the right to change subscription pricing with 30 days' notice
• Failure to pay may result in downgrade to the Free tier
• All prices displayed on the website are exclusive of applicable taxes (such as VAT, sales tax, or GST). The final amount charged may be higher than the listed price, as taxes will be calculated at checkout based on your location and applicable tax regulations
• You are responsible for any taxes associated with your use of the Service, other than taxes based on ForeverPet's income

5. User Content

You retain ownership of all content you upload to ForeverPet, including photos, videos, and text. By uploading content, you grant ForeverPet a non-exclusive, worldwide license to host, display, and distribute your content solely for the purpose of providing the Service. You represent that:

• You own or have the right to use all content you upload
• Your content does not violate any third-party rights
• Your content is appropriate and does not contain harmful or illegal material

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Upload content that is offensive, abusive, or inappropriate
• Attempt to gain unauthorized access to any part of the Service
• Interfere with or disrupt the Service or its infrastructure
• Use automated tools to scrape or collect data from the Service
• Impersonate another person or entity

7. Memorial Visibility

Memorials can be set to public or private. Public memorials are accessible to anyone with the link. Private memorials are only accessible to the account owner. You are responsible for managing the visibility settings of your memorials. ForeverPet is not responsible for content shared via public memorial links.

8. Termination

We may suspend or terminate your account if you violate these Terms. Upon termination, your right to use the Service ceases immediately. You may request export of your data within 30 days of account termination. After 30 days, all data associated with the terminated account may be permanently deleted.

9. Limitation of Liability

ForeverPet is provided "as is" without warranties of any kind. We are not liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability is limited to the amount you have paid for the Service in the 12 months preceding the claim. We do not guarantee uninterrupted or error-free service.

10. Governing Law

These Terms are governed by and construed in accordance with applicable laws. Any disputes arising from these Terms or the Service shall be resolved through good-faith negotiation first, and if necessary, through binding arbitration.
